What's the process for a wrongful dismissal claim in Malaysia?
A dismissed employee generally has 60 days from the date of dismissal to file a representation with the Industrial Relations Department. If conciliation fails, the matter may be referred to the Industrial Court for a full hearing.
Can an employee be dismissed without notice?
Dismissal without notice is generally only lawful for serious misconduct, following a proper investigation and, where appropriate, a domestic inquiry. Dismissing without following a fair process can expose an employer to a wrongful dismissal claim.
